1. About the service and us
Handyletters is a service from Skriveriet. The service is provided by Cabanossy AB (Swedish company reg. no. 559213-0834), Sannaplan 8A, 414 71 Göteborg, Sweden, email hej@skriveriet.se. In these terms we are called “we” or “us”, and you, who place the order, “you”.
With Handyletters you write what you want to say, choose a pen and a handwriting, and give the recipient’s address and your return address. Skriveriet’s handwriting machines then write the letter and the envelope with a real pen, and we post the letter for you.
These terms apply when you order a letter. Please read them before you pay.
2. Who can order
You must be at least 18 years old to order.
3. Order and contract
Before you pay, you see a preview of the letter and the envelope with the pen and handwriting you have chosen. That preview is what you approve when you go on to payment.
The contract becomes binding once the payment has gone through.
The letter is written by a machine with a real pen and real ink. Small differences from the preview are therefore natural, for example in the thickness of the lines and the colour of the ink. Colours on screen can also differ slightly from paper and ink in real life.
4. Prices and payment
All prices are in euros or US dollars, whichever you have chosen, including Swedish VAT (25 %). Postage is included for letters to recipients anywhere in the world.
Extras, such as extra pages, a postage stamp and scheduled posting, cost what is shown before you pay. The total price is always shown before you go on to payment.
Payment is made through our payment provider Stripe. We do not see or store your card details.
5. Posting and delivery time
We post the letter within 2 working days after the payment has gone through. If you have scheduled the posting, we post the letter on the day you have chosen. The date is when the letter is posted, not when it arrives.
The letters are posted in Sweden and delivered by PostNord under PostNord’s terms and delivery times for letters, and for letters abroad by the postal service in the recipient’s country. Letters abroad usually take a few days longer to arrive. We therefore cannot guarantee on which day the letter arrives.
6. Your responsibility for the content
You are responsible for the text in the letter and for making sure that it does not:
- infringe anyone else’s copyright, trademark or other rights,
- break the law or a decision by a public authority,
- contain threats, harassment, defamation or incitement to hatred against a group,
- contain pornography or depictions of violence,
- violate anyone’s privacy,
- serve fraud or pretending to be someone else, for example a public authority or a company.
We may refuse to write and send a letter that we consider breaks these rules. In that case we refund what you have paid.
You compensate us for costs and damage that arise for us or anyone else if the letter breaks the rules above.
7. Addresses
You are responsible for the recipient’s address and your return address being correct. If the letter cannot be delivered, it is returned to the return address.
We are not responsible for letters that do not arrive because of an error in an address you have given, and you are then not entitled to a refund.
8. Right of withdrawal
There is no right of withdrawal for Handyletters. The letter is made to your instructions and is clearly personalised, so the exception for such goods in the EU’s rules on distance contracts applies (Article 16(c) of Directive 2011/83/EU; in Swedish law chapter 2, section 11, point 3 of lagen (2005:59) om distansavtal och avtal utanför affärslokaler).
This means that an order cannot be changed or cancelled after you have paid. So please check the text, the addresses and the extras before you pay.
9. Complaints
If the letter has a fault that is down to us, for example that the text does not match the preview you approved, that a page is missing or that the letter was damaged by us, you can make a complaint.
Contact us at hej@skriveriet.se within a reasonable time after you notice the fault. A complaint within two months is always in time. Describe the fault, and feel free to send a photo.
For a fault that is down to us, we write the letter again and send it at no cost, or refund what you have paid.
The natural variations that come from writing a letter with a real pen, see section 3, do not count as faults.
10. Lost or delayed letters
Once we have handed the letter to PostNord, PostNord’s terms for letters apply. We are not responsible for delays or for letters lost in the post.
In any case our liability is limited to what you have paid for the letter, unless otherwise required by mandatory law.
11. Limitation of liability
We are not liable for indirect damage or loss, and our liability is limited to what you have paid for the order. These limitations do not apply if we have caused the damage intentionally or through gross negligence.
Nothing in these terms limits the rights you have as a consumer under mandatory law, including the law of the country where you live.
12. Force majeure
We are released from our obligations for as long as we are prevented by something beyond our control that we could not reasonably have foreseen, for example a strike, disruption to the postal service, fire, flood, a decision by a public authority or an outage of power, internet or IT systems.
13. Rights to the text
The text you write is yours. You give us the right to use it to the extent needed to write, check and send the letter.
We only read the text when needed to carry out the order, and we treat its content as confidential. We never use your letter in marketing.
The website, the handwriting styles and the technology behind the service belong to us.
14. Personal data
Cabanossy AB is the controller of the personal data we process in the service. We process your and the recipient’s name and address, the text of the letter and the email address you give when paying. We do so to carry out and document the order and to fulfil our contract with you.
Payment is handled by Stripe. To show prices in your currency, we look up which country your IP address is in, in a database on our own server; the address is not saved. When you search for the recipient’s address, what you type is sent to Google to find address suggestions. The letter and envelope to be written are saved with the order. Data for orders that are not paid within a day is deleted.
You have the right to know what data we hold about you and to ask us to correct or delete it. Contact us at hej@skriveriet.se. You can also complain to the Swedish Authority for Privacy Protection (IMY) or to the data protection authority in the country where you live.
15. Changes to the terms
We may change these terms. Your order is governed by the terms that applied when you paid.
16. Disputes and applicable law
Swedish law applies to these terms, without you losing the protection you have under the mandatory rules of the country where you live. If you are not satisfied, please contact us first at hej@skriveriet.se and we will try to solve it together.
If we cannot agree, you as a consumer can turn to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, Sweden, arn.se. If you live in another EU country, Iceland or Norway, the European Consumer Centre in your country can help you for free. Disputes can also be tried by the courts.
